U.S. District Judge Lucy Koh has thrown Samsung’s second injunction stay appeal in two days. After rejecting Galaxy Tab 10.1’s injunction stay appeal, the Judge denied to lift the ban from Galaxy Nexus, effectively barring sales of Samsung’s second Nexus device in the United States. The Galaxy Nexus was banned by the Court as it was found to have infringed Apple’s unified search patent. However, Samsung and Google are not taking it lying down.
While Samsung has already appealed to the Federal Appeals Court for the injunction to be lifted, Google will circumvent the injunction by releasing a software update that they believe “avoids infringing the Apple patent.” Google expects to release the patch pretty soon.
