Good news for Samsung this morning as UK Appeals court have sustained the original decision that ruled Samsung's Galaxy Tab to not infringe Apple's iPad patents. The high court judge in July claimed Galaxy Tab “not as cool” as the iPad and hence did not create any confusion in the minds of the consumers. The judge had also ordered Apple to post ads saying that Galaxy Tab didn't infringe their patents and though Apple got some reprieve in July, the upholding of decision means, Apple will have to run those ads with the result of the rulings.
Samsung spokesperson commented on the ruling by saying that “we continue to believe that Apple was not the first to design a tablet with a rectangular shape and rounded corners and that the origins of Apple's registered design features can be found in numerous examples of prior art.Should Apple continue to make excessive legal claims in other countries based on such generic designs, innovation in the industry could be harmed and consumer choice unduly limited.”
