
An appeal was then filed by Samsung against the damages awarded to Apple and it scored a partial victory, last month the US Court of Appeals revised its judgement and ruled that instead of paying $930 million in damages Samsung would have to pay Apple $548 million. Samsung has now approached a federal appeals court in the US to reconsider last month's ruling which upholds the damages awarded to Apple, it has urged the U.S. Federal Circuit Court of Appeals to hear the case again with its full 12-judge roster claiming that the three-judge panel that gave this ruling had erred when they upheld the previous verdict.
In papers filed with the court Samsung's lawyers argue that “Unlike rugs, spoons, and simple mechanical objects, smartphones incorporate hundreds or thousands of different patented technologies, and it is undisputed here that Apple's design patents claim only partial, minor features of such devices.” No comment by Apple as yet on this latest legal move from Samsung but we can expect the company to fight till the very end to receive the damages it feels itself entitled to.
